Interdicts

An Interdict is a Court Order forbidding someone from behaviour that causes you or the members of your household, to suffer physical harm, distress, alarm, or fear. Powers of Arrest are attached onto Interdicts, coming into effect, if the Interdicted person breaches the Interdict. If any breaches of the Interdict do occur, the Interdicted person, who is subject also to the Power of Arrest can be arrested and thereafter, potentially face a prison sentence. Powers of Arrest can last for up to three years.

Matrimonial interdicts

A Matrimonial Interdict prohibits a person from committing harmful behaviour, aimed at their spouse, their partner, or their children. It can also forbid the person from being within a certain distance of their spouses or partner’s home. or place of work, or even their child’s school. A spouse can apply for an interdict whether they live with their partner.

Exclusion Orders

In cases where your spouse or partner have a legal right to live with you, in your family home, because they have legal Occupancy Rights, you would need to apply to the Court for an Exclusion Order, in cases where their behaviour is violent, threating, or is likely to cause you or someone in your household physical, psychological or emotional harm.
